The recognition of the certificates of professional competence of the drivers who perform transport of passengers by trolleybus, in Romania\r\n\r\n
In accordance with the provisions of the Government Emergency Ordinance nr. 195/2002 regarding traffic on public roads, with subsequent amendments and completions, the drivers who perform transport of passengers by trolleybus must hold a certificate of professional competence. In accordance with the provisions of art. 11, paragraph (1) of the Order of the Minister of Transport, Infrastructure and Communications no. 1033/2020 on the recognition of professional qualifications for the professions governed by the law in Romania for which the Romanian Road Transport Authority - ARR is the competent authority, the certificates for drivers who perform transport of passengers by trolleybus of nationals of a Member State of the European Union other than Romania, or a State belonging to the European Economic Area or of Swiss Confederation issued by the competent authority of one of those States a forehead mentioned, are recognised in Romania. In order to practice the profession in Romania, the holder of the certificate of professional competence will submit an application accompanied by the documents provided below in the chapter \"Required documents\". Romanian Road Transport Authority - ARR confirm to the applicant the receipt of the dossier within 30 days from the date of receipt and inform him, as appropriate, of the absence of any document or if the documents submitted do not meet the requirements for recognition of qualification. If the requested documents are not received at the headquarters of the Romanian Road Transport Authority - ARR within 60 days from the date of communication, the dossier shall be closed. In this case, for the recognition of the professional qualification, the applicant must return with a new application accompanied by the corresponding documents, in accordance with the regulations in force at the date of application. If the dossier is complete or after completing it with the requested documents, the Romanian Road Transport Authority - ARR requests from the competent authority of the State in which the certificate was issued, information on its administrative validity, if it confers on the holder the full right to exercise the profession lawfully, and if its validity is conditioned by participation in periodic training courses. We also specify that the final notification of the applicant depends on the time in which the reply is received from the certificate issuing authorities. The recognition procedure also applies to a Romanian citizen or of an EU Member State, state of the EEA or of the Swiss Confederation if he/she holds a certificate of professional training issued by a third country, if he/she has at least 3 years of professional experience attested by an EU Member State, state of the EEA or by the Swiss Confederation where he has obtained the recognition of professional qualification. In this case, the applicant will also submit the document proving the professional experience in legalised copy and authorised translation. Issuing the license for activities related to public road transport – transport intermediary activities.
In compliance with the Order of the Ministry of Transport and Infrastructure no. 980 of 2011, the Romanian Road Transport Authority - ARR is the public institution that issues the transport operators the license for activities related to public road transport - transport intermediary activities. The license is issued for the economic operators (EO) who comply with the following conditions: an effective and stable establishment in a Member State; appropriate financial standing, professional competence, good repute, in compliance with the art. 126 of the Ministry of Transport and Infrastructure nr. 980 of 2011. In case the EO owns working places /branches where he/she performs intermediary activities of public road transport, shall request for each of them a license for activities related to public road transport.

Issuing the licence for activities related to public road transport, bus station activities
Romanian Road Transport Authority - ARR issues the undertakings, the licence for activities related to public road transport, bus station activities, according to the Order of the Minister of Transport, and Infrastructure no. 980/2011. The licence is issued to those undertakings who comply with the following conditions: an effective and stable establishment and appropriate technical equipment/necessary administrative equipment, professional competence and good repute, according to the provisions of art.118 of the Order of the Minister of Transport and Infrastructure no. 980/2011. In case the EO owns working places/branches where he/she performs bus station activities, shall request for each of them a license for activities related to public road transport bus station activities.

PROCEDURE on the recognition on the Romanian territory of the professional attestations for road safety auditor\r\n
In accordance with art. 7. para. (5) of Law no. 265/2008 regarding traffic safety management on road infrastructure, republished, with subsequent amendments and completions, for the citizen of a Member State of the European Union or of a State belonging to the European Economic Area or of the Swiss Confederation, who has acquired the status of road safety auditor in one of these states, the Commission recognizes the certificate issued by the competent authority of the state of origin, based on which the citizen legally exercises the profession, according to the provisions of Law no. 200/2004 on the recognition of diplomas and professional qualifications for regulated professions in Romania, with subsequent amendments and completions. Thus, the Romanian Road Transport Authority - ARR will verify to the issuing authorities of the Member State of the European Union or of the European Economic Area or Swiss Confederation and depending on the response received from these authorities the applicant will be notified. We mention that the final notification of the applicant depends on the time in which the reply is received from the issuing authorities of the documents. Remedies: We also specify that the person who considers himself injured in a right or in a legitimate interest, by a public authority, by an administrative act or by not resolving a request within the legal term, have the right to appeal the Administrative Court, according to the Law no. 544/2004 of the administrative contentious, with subsequent amendments and completions. Recognition on the Romanian territory of professional certificates for safety advisers for the carriage of dangerous goods by road
In accordance with the provisions of the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR), concluded in Geneva on 30 September 1957, to which Romania acceded by Law no. 31/1994, as subsequently amended and completed, each undertaking, the activities of which include the consigning or the carriage of dangerous goods by road, or the related packing, loading, filling or unloading shall appoint one or more safety advisers for the carriage of dangerous goods by road, holding certificates of professional competence for the transport of dangerous goods by road. In accordance with the provisions of the art. 4 paragraph (1) of the Order of the Minister of Transport, Infrastructure and Communications no. 1033/2020 on the recognition of professional qualifications for the professions governed by the law in Romania for which the Romanian Road Transport Authority - ARR is the competent authority, the valid certificates for safety advisers for the carriage of dangerous goods by road, issued in accordance on provisions of the European Agreement concerning International Carriage of Dangerous Goods by Road (ADR), concluded in Geneva on 30 September 1957, to which Romania adhered by Law no. 31/1994, as subsequently amended and completed, in other Member States of the European Union, of European Economic Area or Swiss Confederation by the competent authorities or appointed structures by those States a forehead mentioned, are recognised in Romania as being equivalent to those issued by the Romanian authority. Recognition on the Romanian territory of professional certificates for managers for road haulage or passengers transport
In accordance with the provisions of Government Ordinance no. 27/2011 on road transport, in order to carry out road transport operations on the Romanian territory, the Romanian road transport operators have the obligation to appoint a road transport manager holding a certificate of professional competence issued in accordance with the provisions of Regulation (EC) No. 1071/2009 of the European Parliament and the Council. In accordance with the provisions of art. 2 paragraph (1) of the of Order of the Minister of Transport, Infrastructure and Communications no. 1033/2020 on the recognition of professional qualifications for the professions governed by the law in Romania for which the Romanian Road Transport Authority - ARR is the competent authority, the certificate for road transport manager valid and issued by the competent authorities or by the authorised bodies, mentioned in art. 8 paragraph (3) of the Regulation (EC) No. 1071/2009 of the European Parliament and of the Council of 21 October 2009 establishing common rules concerning the conditions to be complied with to pursue the occupation of road transport operator and repealing Council Directive 96/26/EC, of nationals of a Member State of the European Union other than Romania, or a State belonging to the European Economic Area or of Swiss Confederation issued by the competent authority of one of those States a forehead mentioned, are recognised in Romania. In order to accept the certificate of professional competence, its holder will submit an application accompanied by the documents provided below in the chapter \"Required documents\". The recognition of the certificates of professional competence of the drivers performing road transport of dangerous goods (ADR).
According to the provisions of Government Ordinance no. 27/2011 on road transport, he drivers performing road transport of dangerous goods must be issued a professional certificate. For the recognition of the of professional certificate of the drivers performing road transport of dangerous goods, the nationals of EU member states, EEA or Swiss Confederation member states, holders of a certificate of professional competence of drivers performing road transport of dangerous goods (ADR) shall submit an application form and the certificate of professional competence in copy (two-sided, front and back sides). The Romanian Road Transport Authority - ARR shall contact the issuing authority of the EU member state in order to check the authenticity and validity of the respective certificate and, according to its answer, shall notify the applicant. Please, note that the sooner the issuing authority answers, the sooner the applicant shall be notified. The recognition of the certificates of professional competence of the drivers who perform national road transport of defective or damaged vehicles for hire or reward, in Romania
In accordance with the provisions of the Government Ordinance no. 27/2011 on road transport and the Methodological norms on application the provisions regarding the organization and performing of road transport and their related activities established by the Ministry Order 980/2011, drivers who perform national road transport of defective or damaged vehicles for hire or reward, must hold a certificate of professional competence. In accordance with the provisions of Art.11, paragraph (1) of Order of the Minister of Transport, Infrastructure and Communications no. 1033/2020 on the recognition of professional qualifications for the professions governed by the law in Romania for which the Romanian Road Transport Authority - A.R.R. is the competent authority, all the certificates or attestations of nationals of a Member State of the European Union other than Romania, or a State belonging to the European Economic Area or of Swiss Confederation issued by the competent authority of one of those States a forehead mentioned for drivers who perform national road transport of defective or damaged vehicles for hire or reward, are recognised in Romania. The recognition of the certificates of professional competence of manager for taxi and rental transport, in Romania.
In accordance with the provisions of the Law no. 38/2003 on taxi and rental transport, manager for taxi and rental transport means a natural person employed by an authorised carrier who permanently and effectively runs taxi and rent transport activities by car. In Romania, the professional training and certification of the manager for taxi and rental transport is regulated by the Norms approved by Government Decision no. 879/2016. In accordance with the provisions of art. 12 of the of Order of the Minister of Transport, Infrastructure and Communications no. 1033/2020 on the recognition of professional qualifications for the professions governed by the law in Romania for which the Romanian Road Transport Authority - ARR is the competent authority, the certificates of managers for taxi and rental transport of nationals of a Member State of the European Union other than Romania, or a State belonging to the European Economic Area or of Swiss Confederation issued by the competent authority of one of those States a forehead mentioned, are recognised in Romania. Recognition in Romania of the teacher for road traffic regulations attestation obtained in other Member States of the European Union or of the European Economic Area or in the Swiss Confederation
In accordance with the Norms regarding the attestation of the teachers of road traffic regulations and of the driving instructors, approved by OMT no. 733/2013, the Romanian Road Transport Authority - ARR issues the certificate of teacher for road traffic regulations for carrying out the activity of theoretical training of persons in order to obtain a driving licence. Teachers for road traffic regulations attested in other member states of the European Union or of the European Economic Area or in the Swiss Confederation, who are established in Romania, may request the Romanian Road Transport Authority - ARR recognition of the attestation, in order to exercise the profession in Romania. In order to gain access to the profession, the applicant must submit a request to this effect, a copy of the certificate of professional competence, a copy of the identity document, double-sided copy of the driving licence valid for at least category B, a driving record certificate from the State of origin, the criminal record certificate or an equivalent document from the Member State of origin, notarial declaration on his own responsibility showing that he/she has not suspended the exercise of the right to drive motor vehicles in the last year or more than twice in the last 15 years for alcohol consumption and also that he/she has not had his driving licence revoked in the last 10 years, the document certifying that the conditions regarding the applicant's physical and mental health (or the document requested in the home Member State) and the study certificate or the attestation of recognition/equivalence issued by the Ministry of Education and Research in the case of the study documents issued in other states. Romanian Road Transport Authority - ARR confirm to the applicant the receipt of the dossier within 30 days from the date of receipt and inform him, as appropriate, of the absence of any document or if the documents submitted do not meet the requirements for recognition of qualification. Recognition in Romania of the driving instructor attestation obtained in other Member States of the European Union or of the European Economic Area or in the Swiss Confederation
In accordance with the Norms on the attestation of driving instructors, approved by OMT no. 733/2013, the Romanian Road Transport Authority - ARR issues the attestation of driving instructor for carrying out the activity of practical training of persons in order to obtain a driving licence. Driving instructors attested in other member states of the European Union or of the European Economic Area or in the Swiss Confederation, who are established in Romania, may request the Romanian Road Transport Authority - ARR recognition of the attestation, in order to exercise the profession in Romania. In order to gain access to the profession, the applicant must submit a request to this effect, a copy of the attestation of professional competence, a copy of the identity document, a double-sided copy of the driving licence valid for the categories for which recognition is sought, a driving record certificate from the State of origin, the criminal record certificate or an equivalent document from the Member State of origin, notarial declaration on his own responsibility showing that he/she has not suspended the exercise of the right to drive motor vehicles in the last year or more than twice in the last 15 years for alcohol consumption and also that he/she has not had his driving licence revoked in the last 10 years, the document certifying that the conditions regarding the applicant's physical and mental health (or the document requested in the home Member State) and the study certificate or the attestation of recognition/equivalence issued by the Ministry of Education and Research in the case of the study documents issued in other states. Romanian Road Transport Authority - ARR confirm to the applicant the receipt of the dossier within 30 days from the date of receipt and inform him, as appropriate, of the absence of any document or if the documents submitted do not meet the requirements for recognition of qualification. The recognition of the certificate of professional competence (CPC) that certifies the initial qualification or periodic training of the drivers, nationals of EU member states, and allows the holders to undertake carriage of goods or passengers by road.
According to the provisions of the Government Ordinance no. 27/2011 on road transport, drivers engaged in the carriage of goods or passengers by road, holding a category D1, D1E, D or DE license, and respectively, C1, C1E, C or CE license, must be the holders of a CPC certifying the initial qualification (CPI) or a CPC certifying the periodic training (CPC), as the case may be. The Government Ordinance no. 27/2011 and the Minister of Transports Order no. 1214/2015, also stipulate that, the only valid certificates recognized in Romania are the CPI and CPC issued by other member states according to the provisions of Directive 2003/59/CE, as further amended and completed. Accordingly, as provided for in the before mentioned Directive, in order to check if a driver meets the requirements, member states shall issue him/her a certificate of professional competence, hereinafter called CPC, certifying the initial qualification or the periodical training. It is also stipulated that member states may affix the Community Code established by the Directive 91/439/CEE either to the driving license, together with the expiry date of the qualifications, alongside the categories for which the initial qualification or the periodical training are certified, or to the driver qualification card. The Driver Qualification Card issued by the EU member states is mutually recognized by the member states. In order to recognize in Romania the CPC certifying the initial qualification or the periodic training of the EU nationals, which allows the holders to undertake road transport activities using vehicles for which a driving license for category D1, D1E, D or DE and, respectively, C1, C1E, C or CE is required, the applicants shall submit an application form, a two-sided copy of the CPC and the driving license in copy (for those having marked the Community Code on their driving license. The Community Code certifies, given the Directive 91/439/CEE, that the respective driver is the holder of a CPC and meets the requirement of professional competence as provided for in the Directive 2003/59/CE, until the expiry date alongside the category license). The Romanian Road Transport Authority - ARR shall contact the issuing authority of the EU member states, in order to check the authenticity and validity of the documents attached (driving license and CPC) and, according to its answer, shall notify the applicant. Please, note that the sooner the issuing authority of the CPC/driving license answers, the sooner the applicant shall be notified. Any person who considers himself harmed in its right or a legitimate interest by a public authority through administrative acts or failure to resolve a claim, have the right to appeal the Administrative Court, according to the Law 544/2004 on administrative contentious, as further amended and completed.
