In accordance with the provisions of the Government Emergency Ordinance nr. 195/2002 regarding traffic on public roads, with subsequent amendments and completions, the drivers who perform transport of passengers by trolleybus must hold a certificate of professional competence.
In accordance with the provisions of art. 11, paragraph (1) of the Order of the Minister of Transport, Infrastructure and Communications no. 1033/2020 on the recognition of professional qualifications for the professions governed by the law in Romania for which the Romanian Road Transport Authority - ARR is the competent authority, the certificates for drivers who perform transport of passengers by trolleybus of nationals of a Member State of the European Union other than Romania, or a State belonging to the European Economic Area or of Swiss Confederation issued by the competent authority of one of those States a forehead mentioned, are recognised in Romania.
In order to practice the profession in Romania, the holder of the certificate of professional competence will submit an application accompanied by the documents provided below in the chapter \"Required documents\".
Romanian Road Transport Authority - ARR confirm to the applicant the receipt of the dossier within 30 days from the date of receipt and inform him, as appropriate, of the absence of any document or if the documents submitted do not meet the requirements for recognition of qualification.
If the requested documents are not received at the headquarters of the Romanian Road Transport Authority - ARR within 60 days from the date of communication, the dossier shall be closed. In this case, for the recognition of the professional qualification, the applicant must return with a new application accompanied by the corresponding documents, in accordance with the regulations in force at the date of application.
If the dossier is complete or after completing it with the requested documents, the Romanian Road Transport Authority - ARR requests from the competent authority of the State in which the certificate was issued, information on its administrative validity, if it confers on the holder the full right to exercise the profession lawfully, and if its validity is conditioned by participation in periodic training courses.
We also specify that the final notification of the applicant depends on the time in which the reply is received from the certificate issuing authorities.
The recognition procedure also applies to a Romanian citizen or of an EU Member State, state of the EEA or of the Swiss Confederation if he/she holds a certificate of professional training issued by a third country, if he/she has at least 3 years of professional experience attested by an EU Member State, state of the EEA or by the Swiss Confederation where he has obtained the recognition of professional qualification. In this case, the applicant will also submit the document proving the professional experience in legalised copy and authorised translation.
Any person who considers himself harmed in its right or a legitimate interest by a public authority through administrative acts or failure to resolve a claim, have the right to appeal the Administrative Court, according to the Law no. 544/2004 on administrative contentious, as further amended and completed.
